When CBS Canceled The Smothers Brothers Comedy Hour for Criticizing the American Establishment and the Vietnam War (1969)

Rig­or­ous­ly clean-cut, com­pe­tent on the acoustic gui­tar and dou­ble bass, and sel­dom dressed in any­thing more dar­ing than cher­ry-red blaz­ers, Tom and Dick Smoth­ers looked like the antithe­sis of nine­teen-six­ties rebel­lion. When they first gained nation­al recog­ni­tion with their vari­ety show The Smoth­ers Broth­ers Com­e­dy Hour, they must have come off to many young view­ers as the kind of act of which their moth­er — or even grand­moth­er — would approve. But the broth­ers’ cul­ti­vat­ed­ly square, neo-vaude­vil­lian appear­ance was deceiv­ing, as CBS would soon find out when the two took every chance to turn their pro­gram into a satir­i­cal, relent­less­ly author­i­ty-chal­leng­ing, yet some­how whole­some show­case of the coun­ter­cul­ture.

The Smoth­ers Broth­ers Com­e­dy Hour pre­miered in Feb­ru­ary of 1967, and its first sea­son “fea­tured min­i­mal con­tro­ver­sial con­tent,” writes Sarah King at U.S. His­to­ry Scene. There­after, “the show became increas­ing­ly polit­i­cal. The broth­ers invit­ed activist celebri­ties onto their show, includ­ing folk singers Pete Seeger and Joan Baez and singer-actor Har­ry Bela­fonte.

The show also pro­duced its own polit­i­cal mate­r­i­al crit­i­ciz­ing the Viet­nam War and the politi­cians who sup­port­ed it,” not least Pres­i­dent Lyn­don John­son. Bring­ing on Seeger was a dar­ing move, giv­en that he’d been black­list­ed from net­work tele­vi­sion for the bet­ter part of two decades, though CBS’s cen­sors made sure to cut out the most polit­i­cal­ly sen­si­tive parts of his act.

Even more so was the broth­ers’ own per­for­mance, with George Segal, of Phil Ochs’s “Draft Dodger Rag,” which they end­ed by urg­ing their audi­ence to “make love, not war.” All this can look fair­ly tame by today’s stan­dards, but it locked the show — which had become top-rat­ed, hold­ing its own in a time slot against the cul­tur­al phe­nom­e­non that was Bonan­za — into a grudge match with its own net­work. Before the third sea­son, CBS’ high­er-ups demand­ed that each show be turned in ten days in advance, osten­si­bly in order to under­go review for sen­si­tive mate­r­i­al. In one instance, they claimed that the dead­line had­n’t been met and aired a re-run instead, though it may not have been entire­ly irrel­e­vant that the intend­ed pro­gram con­tained a trib­ute by Baez to her then-hus­band, who was being sent to prison for refus­ing to serve in the mil­i­tary.

CBS did broad­cast Baez’s per­for­mance on a lat­er date, after clip­ping out the ref­er­ence to the spe­cif­ic nature of her hus­band’s offense. A sim­i­lar strug­gle took place around the “ser­mon­ettes” deliv­ered by David Stein­berg, one of which you can see in the video above. The irrev­er­ence toward U.S. for­eign pol­i­cy, reli­gion, and much else besides in these and oth­er seg­ments even­tu­al­ly proved too much for the net­work, which fired the broth­ers after it had already giv­en the green light to a fourth sea­son of the Com­e­dy Hour. Though they suc­cess­ful­ly sued CBS for breach of con­tract there­after, they nev­er did regain the same lev­el of tele­vi­su­al promi­nence they’d once enjoyed, if enjoy be the word. At any rate, the fall­out of all this con­tro­ver­sy firm­ly installed the Smoth­ers Broth­ers in the pan­theon of twen­ti­eth-cen­tu­ry free-speech war­riors, and their expe­ri­ence reminds us still today that, with­out the free­dom to give offense, there can be no com­e­dy wor­thy of the name.

    You buf­foons real­ly just don’t get it.. Kim­mel was­n’t pulled off the air for “speak­ing out against the estab­lish­ment”. He was pulled for DELIBERATELY LYING on the air about Char­lie Kirk’s assas­sin, slan­der­ing and dan­ger­ous­ly accus­ing a group of peo­ple who had noth­ing to do with. He KNEW he was lying when he said it.

    That bla­tant lie right­ly angered net­works , who refused to air his show, and Dis­ney then pulled him because he was COSTING THEM MONEY, as is a busi­ness’ right. His rat­ings also SUCKED even before that. So this turn­ing him into a hero that you’re going to cru­sade for is just ridicu­lous and tire­some.

    I was 9 years old when that hap­pened, and I still remem­ber it. It was such a huge, shock­ing, and con­tro­ver­sial event, it dom­i­nat­ed the news to the point that 9 yo’s heard all about it. It was huge because of the threat to our First Amend­ment rights. Peo­ple who did­n’t appre­ci­ate the Smoth­ers Broth­ers or their takes were as out­raged as those who sup­port­ed them, because it’s one thing to dis­like some­one’s speech, and it’s a whole dif­fer­ent thing to pre­vent them from say­ing it.

    You are cor­rect. Kim­mel used the ini­tial press report that the killer came from a MAGA fam­i­ly and he should not have used pre­lim­i­nary info in his monolog as a state­ment of fact.     Per­haps you should lis­ten to Pete’s song “Lit­tle Box­es”, as it seems that Pete was right about edu­ca­tion in Amer­i­ca. Today’s group think over­runs many indi­vid­u­als abil­i­ty to devel­op their own ideas through cre­ativ­i­ty and log­i­cal think­ing.     Even if you think Kim­mel was wrong or reck­less in what he said, that does­n’t change the fact that the FCC chair pub­licly threat­ened broad­cast licens­es over a host’s polit­i­cal com­men­tary. That’s not a “busi­ness deci­sion,” that’s gov­ern­ment pres­sure chill­ing speech, and it’s exact­ly what the First Amend­ment for­bids. Net­works can can­cel shows for bad rat­ings or com­men­tary they find objec­tion­able, but when fed­er­al reg­u­la­tors use licens­ing threats to steer polit­i­cal con­tent, it cross­es into uncon­sti­tu­tion­al ter­ri­to­ry.

    Noth­ing in the Con­sti­tu­tion reserves you the right to say what you want on tele­vi­sion. You can com­plain your employ­er isn’t let­ting you express your­self at work, but the Con­sti­tu­tion does­n’t allow you to say what you want to the detri­ment of your employ­er, par­tic­u­lar­ly when it’s a per­son­al opin­ion. You can say what you want, but you are not pro­tect­ed from oth­er pri­vate indi­vid­u­als’ opin­ions. Unless it’s a clear whistle­blow­er sit­u­a­tion, an employ­er is well with­in its rights to remove you from its employ­ment if it does­n’t agree with your speech or finds it hurts the employ­er in some way. The Smoth­ers Broth­ers had a con­tract and were com­pen­sat­ed for the break­ing of that con­tract, but not because their free speech rights were vio­lat­ed — which they weren’t — but because CBS said in a con­tract they would give the broth­ers anoth­er sea­son for their show and then vio­lat­ed the con­tract by can­celling the show. You are not enti­tled to say what­ev­er you like with­out reper­cus­sions from oth­er pri­vate indi­vid­u­als. The gov­ern­ment is pre­vent­ed by the 1st Amend­ment from silenc­ing peo­ple; it does not pro­tect any­one from pub­lic opin­ion. Like­wise, no one is enti­tled to spout demon­stra­bly false infor­ma­tion… We have slan­der and libel laws, and employ­ers are acute­ly aware of their expo­sure to those laws by their employ­ees. Are some peo­ple on both sides tak­ing their reac­tions to extremes — yes, as has become all too nor­mal in this coun­try. Trump and his peo­ple need to think before act­ing and speak­ing, which isn’t hap­pen­ing fre­quent­ly enough fol­low­ing the Kirk assas­si­na­tion; some of that can be explained by grief and shock, but gov­ern­ment can’t act like a pri­vate indi­vid­ual. Like­wise, peo­ple on the left need to show com­mon decen­cy when some­one with which they dis­agree is gunned down while try­ing to com­mu­ni­cate and con­nect with oth­ers; you don’t sup­port, defend or glo­ri­fy that.

    Lit­er­al­ly every­thing you said was wrong. Jim­my Kim­mel did­n’t lie about any­thing. He said that the Trump admin­is­tra­tion (who he accu­rate­ly referred to as the “MAGA gang”) was try­ing to make it look like there is no way the shoot­er could pos­si­bly be a MAGA guy him­self and were try­ing to use Kirk’s death to score polit­i­cal points. That’s exact­ly what they did. Kim­mel nev­er claimed that the shoot­er was or was­n’t a MAGA fol­low­er him­self just that the Trump admin­is­tra­tion was try­ing to say there is no way he could be.

    That com­ment pissed off Trump and he used the FCC to black­mail the ABC affil­i­ates (com­pa­nies like Nexs­tar) and Dis­ney to pull the show. Dis­ney and the affil­i­ates com­plied with the black­mail but it was­n’t them that ini­tial­ly made the deci­sion. It was the pres­i­dent cen­sor­ing the media for say­ing things he did­n’t like.

    In the case of the Smoth­ers Broth­ers they weren’t forced off the air by threats from the fed­er­al gov­ern­ment. Jim­my Kim­mel was. This is a clear case of the pres­i­dent of the Unit­ed States threat­en­ing legal action against the media for say­ing some­thing he did­n’t like.

    What he actu­al­ly SAID was the right (I assume that includes you) were tying them­selves into knots try­ing to deny that the shoot­er might be a right-winger. That’s a true state­ment — Trump and oth­ers were claim­ing it was a lib­er­al before they even had a sus­pect in cus­tody.
